By downloading, accessing, or using the Achievo mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these terms, please do not use our App.

2. Description of Service

Achievo is a free goal tracking application that provides task management, reminders, and progress tracking tools. The app offers core features at no cost, with optional premium features available through a one-time purchase, including:

• Unlimited goals (free version has limited goals)
• Advanced AI-powered task suggestions
• Enhanced analytics and insights
• Additional customization options

All data is stored locally on your device, and we do not collect personal information from users.

3. Free and Premium Features

3.1 Free Features

The free version of Achievo includes basic goal tracking, task management, reminders, calendar view, and essential progress tracking features.

3.2 Premium Features

Premium features are available through a one-time in-app purchase and include unlimited goals, advanced AI task suggestions, detailed analytics, and enhanced customization options. Premium features are purchased through Apple's App Store and are subject to Apple's terms and conditions.

3.3 No Account Required

Achievo does not require user accounts or registration. All data is stored locally on your device, ensuring your privacy and data security.

4. User Content and Data

All content you create within the App (goals, tasks, notes, etc.) remains entirely under your control and is stored locally on your device. We do not have access to, collect, or store any of your personal data or content. You are responsible for backing up your data through your device's standard backup mechanisms.

5. Prohibited Conduct

You agree not to:

• Use the App for any illegal purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to our systems or reverse engineer the App
• Interfere with or disrupt the operation of the App
• Use the App to create, store, or share content that is harmful, offensive, or inappropriate
• Attempt to circumvent or disable security features of the App
• Use automated tools or bots to interact with the App

6. Purchases and Payments

6.1 Premium Features

Premium features are available through a one-time purchase processed by Apple through the App Store. All payments are handled by Apple and are subject to Apple's terms and conditions.

6.2 Refunds

Refund requests for premium features should be directed to Apple through the App Store, as we do not process payments directly. Refunds are subject to Apple's refund policy.

6.3 Price Changes

We reserve the right to modify the pricing of premium features at any time. Price changes will not affect purchases already made.

7. Intellectual Property

The App, including all content, features, functionality, and underlying technology, is owned by us and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes. You may not:

• Reproduce, distribute, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Remove or modify any proprietary notices
• Use our trademarks or branding without permission

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT:

• The App will be uninterrupted, secure, or error-free
• The App will meet your specific requirements
• Any errors or defects will be corrected
• The App will be compatible with all devices or operating systems

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM:

• Your use or inability to use the App
• Any unauthorized access to or alteration of your data
• Any interruption or cessation of the App
• Any bugs, viruses, or similar harmful components

Our total liability to you for all claims arising from your use of the App shall not exceed the amount you paid for premium features, if any.

10. Indemnification

You agree to indemnify, defend, and hold us harmless from any claims, damages, losses, costs, and expenses (including reasonable attorney fees) arising from your use of the App, violation of these Terms, or infringement of any rights of another party.

11. Termination

These Terms remain in effect until terminated. You may stop using the App at any time by deleting it from your device. We may terminate your access to the App if you violate these Terms, though since the App functions locally, termination primarily affects your right to use the App legally. Premium features purchased will remain functional unless you delete the App.

12. Updates and Modifications

12.1 App Updates

We may periodically update the App to add features, fix bugs, or improve performance. Updates may be required for continued use of the App.

12.2 Terms Updates

We may modify these Terms at any time. We will notify you of significant changes by posting a notice on our website or through the App. Your continued use of the App after such modifications constitutes your acceptance of the updated Terms.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of Poland, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App will be resolved through binding arbitration in accordance with Polish arbitration rules, except that you may pursue claims in small claims court if they qualify.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will remain in full force and effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
